Age Requirement: Any client placing an order through the KW Servers online system guarantees they are at least 18 years of age and possess the legal capacity to enter into this binding agreement.
Clients Under 18: Minors must obtain explicit, verifiable consent from a parent or legal guardian to access this site and utilize our services. Without this consent, users under 18 must immediately notify us, terminate their services, and are prohibited from using the Company's offerings.
Liability Disclaimer: KW Servers disclaims all liability and responsibility for any legal complications or issues arising from a client's misrepresentation of their age.
Access Requirements: To access the KW Servers control panels, you must provide personal information, which we securely maintain. You are responsible for ensuring all provided data is complete, accurate, and truthful. We reserve the right to refuse service, or immediately suspend/terminate access without a refund, if we detect errors, omissions, falsifications, or suspect fraudulent activity.
Limited Usage License: Subject to this TOS, we grant you a limited, non-exclusive, non-transferable personal license to use our services for private and authorized commercial purposes.
Prohibited Usage: All unlawful use is strictly forbidden. You must prevent unauthorized access to your services. KW Servers reserves the right to impose bandwidth limits and enforce network security measures. Unauthorized use will result in immediate license termination and potential legal prosecution.
To maintain a secure, compliant, and trustworthy infrastructure, KW Servers enforces a mandatory KYC policy.
Required Information: Customers must submit accurate details, including Full Name, Email Address, Phone Number, Address, Country, and Postal Code.
Verification Standards: Orders placed via VPNs, Proxies, or Tor networks are automatically flagged and rejected. If inaccurate information is detected, you will be granted one opportunity to correct it using a valid government-issued ID and biometric verification.
KYC Failure & Refunds: If you fail KYC verification, refunds are strictly limited to payments made via Visa, Mastercard, and American Express (Amex). Payments via Cryptocurrency, alternative gateways, or other non-reversible methods are strictly non-refundable upon KYC failure.
Fraudulent Submissions: Intentionally leaving KYC fields empty or submitting fake information will result in a permanent ban. All associated funds will be frozen, and no refunds will be issued.
Privacy Commitment: Your personal data will never be sold, leaked, or shared with unauthorized third parties. KW Servers is fully committed to data security and confidentiality.
Billing Process: Service setup initiates only after full payment is received. Invoices are generated at least 14 days before the due date. Prompt payment is the client's responsibility.
Payment Options & Suspension: We accept Credit Cards, Crypto (Bitcoin/USDT), Wire Transfers, and other verified methods. If an account holds an outstanding balance for over 24 hours, KW Servers reserves the right to suspend or terminate services until the balance is cleared.
Refund Policy: KW Servers does NOT issue refunds, except in instances covered by our Service Level Agreement (Section 11) or in the event of a proven billing discrepancy.
Automated Subscriptions: Credit card payments automatically activate a subscription, deducting funds on each due date. We do not refund automated renewals. To cancel, you must use the client portal or submit a support ticket prior to your renewal date.
Set-Up Fees: Standard set-up fees for dedicated servers are waived unless custom third-party requirements are necessary.
Dedicated & Bare Metal Servers: High-performance solutions with scalable processing power, RAM, and storage specifications.
Colocation Services: Comprehensive facilities including power supply, cabinet space, uplink connections, and IP allocations.
DDoS Mitigation: Robust Level 3 ingress traffic filtering to defend against Layer 1 through 6 DDoS attacks.
IP Transit Services: Diverse global IP transit connectivity for colocation subscribers.
All materials accessible across our network are the proprietary information of KW Servers. We have a zero-tolerance policy for copyright infringement. You may not copy, distribute, modify, or transmit our website content without prior written consent. Utilizing our services grants you no ownership or intellectual property rights over our platform.
To ensure the security and stability of our global network, we enforce a strict Acceptable Use Policy (AUP). Using our services to host, store, transmit, or promote any of the following is strictly prohibited:
IP Spoofing / Header Forgery: Forging IPs, packet headers, or email headers to hide traffic origins.
Denial of Service (DDoS/DoS): Initiating, participating in, or facilitating network flooding or DDoS attacks.
Malware & C2 Servers: Hosting or distributing malicious software (viruses, trojans, ransomware) or operating Command and Control servers.
Probing & Scanning: Unauthorized port scanning, vulnerability probing, or brute-force attacks.
Phishing: Hosting fraudulent websites, fake login pages, or operating identity theft schemes.
Child Sexual Abuse Material (CSAM): Zero-tolerance. Immediate termination and reporting to law enforcement.
Terrorism & Extremism: Material promoting or instructing on terrorism, violence, or weapon creation.
Human Trafficking: Content facilitating or promoting human trafficking or illegal prostitution.
Illegal Substances: Selling or promoting illegal drugs, contraband, or unlicensed prescription medications.
Carding & Stolen Data: Distributing or storing stolen credit cards, leaked databases, or compromised identity data.
Ponzi Schemes & HYIPs: Hosting High-Yield Investment Programs, pyramid schemes, or crypto frauds.
Fake E-commerce: Operating deceptive business practices or fraudulent online stores.
Unsolicited Commercial Email (UCE): Transmitting bulk Spam or running mailing lists without explicit opt-in consent.
Mail & SMS Bombers: Scripts designed to overwhelm a recipient's inbox or phone.
Blacklisting: Any action resulting in our IPs being listed on global anti-spam databases (e.g., Spamhaus, SORBS).
Warez & Piracy: Hosting copyrighted material without authorization (nulled scripts, keygens, cracks).
Tor Exit Nodes: Operating Tor exit relays, which attract high abuse complaints.
Open Resolvers / Proxies: Running unsecured Open DNS resolvers or Open Proxies weaponizable for amplification attacks.
We actively monitor network traffic for abuse. If your account contains illegal activity (pirated software, malware, illegal files), or violates the AUP, KW Servers reserves the absolute right to immediately suspend, wipe, or permanently terminate your server without prior notice. Under no circumstances will refunds be issued for abuse terminations.
Ransomware & Dark Web Notice: If a server is found hosting Ransomware, malicious Tor Exit Nodes, or Dark Web marketplaces, the hardware will be immediately seized. Exact IP logs, connection histories, and complete KYC data will be unconditionally surrendered to international cybercrime units and local law enforcement for prosecution.
Equipment Collateral: KW Servers reserves the right to assume ownership of colocated equipment if an account remains over 30 days overdue.
Termination Due to Breach: Failure to make timely payments or violating this agreement may result in immediate suspension or termination. Upon termination, we reserve the right to securely and permanently wipe all data stored on the servers.
Upgrades: Requested hardware or service upgrades will take effect at the start of your next billing cycle unless an immediate upgrade is requested and fully paid for in advance.
Setup Time: Standard setups are completed within 24 hours. Provisioning times for dedicated servers may vary depending on current hardware availability.
Cancellations must be requested via a verified support ticket no later than 24 hours before your upcoming billing due date. By canceling, you acknowledge liability for all charges incurred up to the termination date. KW Servers does not issue pro-rated refunds for mid-cycle cancellations.
We guarantee 99.99% network uptime. If we fail to meet this guarantee due to internal network faults, you may be eligible for service credits. Setup fees are strictly non-refundable. For any technical difficulties or SLA claims, clients must contact our support team immediately.
Data Backups: KW Servers does not automatically back up client data unless you have specifically purchased a managed backup service. The subscriber is solely responsible for maintaining independent, off-site backups of all server data.
Liability: Under no circumstances shall KW Servers, its directors, or its employees be held liable for any data loss, hardware failure, hardware degradation, security breaches, loss of profits, or indirect business damages resulting from the use or inability to use our services.
KW Servers shall not be held liable for any failure or delay in performing its obligations under this TOS if such failure is caused by circumstances beyond our reasonable control. This includes, but is not limited to, acts of God, natural disasters, wars, acts of terrorism, government restrictions, massive global internet outages, or power grid failures.
KW Servers reserves the right to amend these Terms and Policies at any time. Changes become effective immediately upon being posted to our website. Your continued use of our services following any updates constitutes your explicit acceptance of the revised terms. If you do not agree with the amendments, you must immediately submit a cancellation request and cease using our platform.
By electing to use cryptocurrency (including, but not limited to, BTC and USDT) to remit payment for our services, you explicitly consent to our rigorous Anti-Money Laundering (AML) and compliance frameworks. These terms apply unconditionally to all customers, whether new or existing.
We utilize sophisticated, real-time blockchain monitoring systems to enforce AML protocols. KW Servers strictly prohibits and will automatically reject any payments originating from or linked to the following high-risk categories:
Child Exploitation & Dark Services: Any entities or networks associated with child abuse, exploitation, drug trafficking, or the financing of terrorism.
Dark Markets & Illegal Services: Digital assets traced to illegal operations, darknet marketplaces, or illicit underground economies.
Cryptocurrency Mixers (Tumblers): Funds intentionally obfuscated through mixers or tumblers to conceal their origin, as these are predominantly linked to money laundering.
Stolen Assets, Scams & Ransomware: Cryptocurrencies obtained via theft, deceptive practices (scams), extortion, or ransomware campaigns.
Sanctioned Entities: Addresses or individuals subject to international sanctions, embargoes, or active judicial enforcement actions.
Fraudulent Exchanges: Platforms involved in exit scams, illicit behavior, or those whose assets have been seized by governmental authorities.
Unlicensed Gambling: Funds associated with unregulated, unlicensed, or illegal online gambling operations.
Terrorism Financing: Any entities flagged by global security databases as critical threats or financiers of terrorism.
Unregulated Crypto ATMs: Assets originating directly from loosely regulated or unverified cryptocurrency ATMs, which pose high risks due to insufficient KYC controls.
If our automated AML systems flag an incoming transaction as associated with any prohibited category, the following actions will be triggered instantly and without exception:
Permanent Freezing of Funds: The tainted cryptocurrency will be immediately isolated and permanently frozen to safeguard our network integrity.
Strict No-Refund Policy: Under no circumstances will blacklisted or high-risk funds be refunded, credited, or returned to the sender.
Immediate Service Termination: All active servers, hosting services, and associated accounts will be terminated instantaneously without prior warning.
Order Cancellation: Any pending orders linked to the flagged transaction will be voided immediately.
Notice: This policy is non-negotiable. By transferring cryptocurrency to our network, you bear absolute responsibility for the legality and origin of your funds.
These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
